Public & Products Liability

Liability policies are amongst the most common and most important policies that anyone in the horse industry should consider. Whether your operation is a Riding School or Agistment Centre, or you provide a specialised equine service, Gow-Gates can offer insurance solutions to protect you and your business against the financial risk of being found liable for death or injury to a third party, or loss or damage of third party property.

Care, Custody and Control

Is essential cover for Agistment and Stud businesses, and anyone who is responsible for other people's horses. This cover provides protection against legal liability incurred as a result of injury or death, or financial loss, in respect of a horse in your care. It also covers the legal expenses in defending such law suits.

Farm Pack

Gow-Gates have put together a Farm Pack policy which is specific to Equestrian Properties. The policy incorporates all of the usual items available under a general Farm pack but has been tailored to include market leading cover for items particularly important to horse owners, such as arenas, stables, horse trucks and saddlery and tack. This package, arranged in conjunction with Gow-Gates' specific Equestrian Liability Policy provides you with tailored cover.

Certificate of Currency

A Certificate of Currency (CoC) is proof that your Association/Club holds a current insurance policy. Typically, local councils or third parties will request to sight your Associations/Clubs Public and Products Liability CoC to confirm that the policy covers the following party for their respective rights and interests.

In order to request a Certificate of Currency, please complete the below fields.

The policy does automatically include the interest of additional parties as follows:

Every principal, in respect of that principal's vicarious or contingent liability for the acts or omissions of one of the Insureds in the performance by them of work for that principal, but subject always to the extent of coverage and the Limit of Liability provided by this Policy.

A Certificate of Currency can be provided naming an interested party in line with the above.

Spectators are not listed as an insured person on the programme. As such, a spectator who is injured cannot make a claim on the Personal Accident policy. Clubs are noted as Insureds on the policy. Therefore, if a spectator was injured and decided to seek damages from the club alleging the club's negligence, then the Public Liability policy would respond. Important, the Public Liability Policy states that you must not admit Liability without the Insurers consent thus any claim made by a spectator must be referred to the Insurer as soon as possible for their instructions.

Unfortunately, the Health Insurance Act 1973 does not allow a policy of this type to cover expenses for which any Medicare rebate is made.

126 Prohibition of certain medical insurance

(1) A person shall not make a contract of insurance with another person that contains a provision purporting to make the first-mentioned person liable to make a payment in the event of the incurring by the other person of a liability to pay medical expenses in respect of the rendering in Australia of a professional service for which Medicare benefit is, or but for subsection 18(4) would be, payable.

Medical expenses for which there is no benefit payable by Medicare are still claimable. These include Ambulance, Physio, Private Hospital Accommodation and Dental amongst others.

Gow Gates and Equestrian Australia recognise that the Equestrian Australia insurance Scheme benefits are not designed to be comprehensive for all members of the equestrian community. It is strongly recommended that you consider the benefits in line with your current circumstances.

Additional Insurance is available for the Capital, Non-Medicare Medical and Loss of Income benefits.

Gow-Gates Financial Services can also provide advice on an Income Protection policy, which can provide cover for injuries that occur participating in equestrian activities and in your day-to-day life.

Under the Personal Accident Injurypolicy, you can claim for Loss of Wages if you work part time, provided you can demonstrate consistent earnings over the 12 months prior to the injury.

Although the Council cannot be noted as a named Insured on the Policy they are automatically indemnified as Landowners under the policy. It can be arranged to note the interest of the Council as property owners on Certificates of Currency to provide cover for their vicarious liability for your use of their grounds, if they wish.

Yes. Only direct members, coaches, and club voluntary workers engaged in EA organised activities, are covered under the Personal Accident policies.

No. Equestrian Australia insurance provides Public Liability cover for your non-income earning activities only. This programme does not extend to cover any income earning activities that you may be engaged in, such as agistment, breaking/training horses, leasing out floats, etc.

Spectators are not listed as an insured person on the programme. As such, a spectator who is injured cannot make a claim on the Personal Accident policy. Clubs are noted as Insureds on the policy. The question is best answered by looking at the two key criteria:

  • What is considered officiating on behalf of an 'EA Insured Club'
  • What is considered a 'Non-Income Earning Equestrian Activity' for the purposes of the insurance policy?

By understanding these two criteria, it is easier to understand when and where the Officials Top Up is required.

EA Club Insurance

If an official is officiating at an EA Affiliated Club that holds the EA Club Insurance, the EA Club Insurance extends automatically to provide coverage to Officials. These officials do not necessarily need to be EA Members, they simply need to be appointed in line with EA's requirements.

There is no requirement regarding income/non-income earning activity where cover is provided by the EA Club Insurance.

The EA Club Insurance applies to all activities run by the relevant clubs for their competitions as well as any other organised club events (such as training days) which are run by the club.

Non-Income Earning Equestrian Activities

Where an Official is not able to rely on the cover provided automatically from the EA Club Insurance (i.e. if the Club does not hold cover through EA – such as Ag Shows), there can be additional coverage available from their insurance as an EA Member.

The policies provided to EA Members(via State Branch Membership) provide cover whilst the member is engaged in 'Non-Income Earning Equestrian Activities'.

With regards to Officials, it has been agreed between Gow-Gates, EA and Underwriters that reimbursement of incurred expenses is NOT income however if additional payments are made, this is considered income. As such, if an official is actually reimbursed for expenses such as Travel, accommodation, meals etc as an official, this is not considered income earning. However if a per-diem or honorarium is paid on top of the reimbursement of actual expenses, this would be considered income earning. (Remember, if this is an EA Club Activity, then the fact that it maybe income earning is not relevant as the Club Insurance does not require the officiating to be Non-Income Earning).

Yes, as an accredited EA coach with insurance purchased through the EA National Insurance Programme, you are covered whilst coaching anyone, anytime, anywhere. Should you undertake any equestrian business activities outside coaching, such as providing agistment services, horse training, operating a riding establishment and so on, please contact the Equine Team to discuss additional insurances — equine@gowgates.com.au

The Public Liability policy does provide vicarious liability to property owners where they are brought into a legal action against you, as a result of your coaching activities conducted on their property (but not for claims where the property owner is found liable for the injuries or damage).

Yes, all covers are in effect at all times whilst coaching, including where it is required you ride in connection with a student lesson. However, in cases where your business extends to taking on clients horses for continued education and/or agistment, additional equine liability protection will need to be purchased.
